Collection AgencyMost of the collection agency are good at their business. Some of them cross the law of the land and end up in doing unlawful activities and often commit collection agency fraud.

The collection agency fraud is like this: the agency solicits the business from one credit manager at a very low rate. Then, they agree on the fee structure. The credit manager places the accounts with the collection agency and then that agency has the right to collect the balance due. But the difference is that the collection agency pockets the money and does not transfer money to original lender. This is the collection agency fraud.

The creditor trusts the agency with collecting the money but these types of scams happen often. Sometimes the creditors get notice about this when they call a debtor and see that the whole amount has been paid. The agency failed to inform the creditor about that. Then, things start to heat up from there.

Usually the creditor will contact the collection agency. Then three things are bound to happen:

  • The collection agency says they did not get the payment.
  • The agency is under business and can not be reached.
  • The collection agency has received the payments from customer and does not send due amount to creditors.

The collection agency fraud revolves around these three outcomes.

On the good side, the agency will admit they got the money but there was an error and they could not clearly determine which client gave the money. Then the problem is solved, but only after the creditor picked up on that.

But if the agency does not admit the fraud, then the creditor can pursue charges on them. But in many cases the collection agencies get away with this because the creditor never finds out that the debtor paid due amount.

In some cases, there is another type of collection agency fraud. The agency may fail to deposit the money and earn interest on that. After a while, when the creditor pressures them, they can give up the money. These are some of the forms of collection agency fraud that are most often encountered.

If collection agency has received full amount from customer and has not returned money to creditors. Earning interest on creditors money is fraud. After taking money from customer not informing creditors is fraud. Not removing negative remarks against customer at collection agency and consumer agency is collection agency fraud.
